1. Acceptance of Terms

By accessing or using our service, you agree to these Terms of Service. If you disagree with any part of these terms, please do not use Amelia Vibe.

2. Description of Service

Amelia Vibe provides AI-powered content generation services. We help professionals maintain a consistent LinkedIn presence by generating, scheduling, and publishing posts they approve. We also offer optional integrations with third-party platforms, including X (Twitter), Google Drive, and OneDrive, to capture content inspiration and enhance your workflow. We provide a browser extension ("Amelia Vibe Extension") that lets you save web content and start chat conversations from any webpage. We also offer optional messaging integrations with Telegram and WhatsApp, allowing you to send content to Amelia Vibe via chat. We reserve the right to modify or discontinue the service at any time.

3. User Accounts

You are responsible for safeguarding your account and for all activity under your account. You must provide accurate information when creating your account and keep it updated.

4. User Content

You retain rights to content you generate using our service. You grant us a license to use, store, and display your content to provide the service.

5. Acceptable Use

You agree not to:

• Use the service for illegal purposes
• Attempt to gain unauthorized access
• Interfere with the proper functioning of the service
• Generate content that violates third-party rights
• Use our service to create misleading or harmful content
• Exceed or attempt to circumvent rate limits or usage restrictions imposed by third-party platform APIs (LinkedIn, X, Google, Microsoft)
• Use the service in any way that violates the terms of service of connected third-party platforms

6. Third-Party Integrations

Amelia Vibe may connect to third-party services such as LinkedIn, X (Twitter), and Google Drive on your behalf. By connecting these services, you acknowledge and agree that:

• Your use of third-party services is subject to those services' own terms of service and privacy policies.
• You authorize Amelia Vibe to access and use data from connected services as described in our Privacy Policy.
• For the X integration, you authorize Amelia Vibe to read your direct messages sent to our X account, send you DM replies, read your public tweets and bookmarks, and refresh your access token automatically.
• For the Google Drive integration, you authorize Amelia Vibe to read file names, metadata, and contents from a specific folder you select, using read-only access. We do not modify, delete, or access files outside your selected folder.
• For the OneDrive integration, you authorize Amelia Vibe to read file names, metadata, and contents from a specific folder you select, using read-only access. We do not modify, delete, or access files outside your selected folder.
• For the browser extension, you authorize Amelia Vibe to capture and process the page URL, title, and any selected text from pages where you explicitly trigger a save or chat action. The extension does not collect data passively or track your browsing activity.
• For the Telegram integration, you initiate the connection by generating a linking code in your dashboard and sending it to our bot (@ameliavibe_bot). We store your Telegram user ID and username to identify your account. Your use of Telegram is subject to Telegram's Terms of Service. You can disconnect at any time from your settings or by sending "stop" to the bot.
• For the WhatsApp integration, you initiate the connection by generating a linking code in your dashboard and sending it to our WhatsApp Business number. We store your phone number and display name to identify your account. Your use of WhatsApp is subject to WhatsApp's Terms of Service. You can disconnect at any time from your settings or by sending "stop" to the bot.
• We are not responsible for downtime, API changes, or policy changes by third-party platforms that may affect integration functionality.
• You may disconnect any integration at any time from your account settings.

7. Payments and Subscriptions

We offer subscription plans with different features. You agree to pay all fees associated with your selected plan. All fees are non-refundable unless required by law.

8. Termination

We may terminate or suspend your account at our discretion, without prior notice, for conduct that violates these terms. You may also terminate your account at any time through your account settings.

9. AI-Generated Content

Amelia Vibe uses artificial intelligence to generate suggested post drafts. All content is presented as a suggestion and is only published when you explicitly approve it. By publishing AI-generated content to LinkedIn or any other platform, you assume full responsibility for that content, including compliance with the destination platform's community guidelines and policies. Amelia Vibe is not liable for any consequences arising from content you choose to publish.

10. Disclaimers and Limitations

The service is provided "as is" without warranties. We are not responsible for content generated using our service. Our liability is limited to the amount you paid for the service in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Amelia Vibe, LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service, (b) content you publish through the service, (c) your violation of these Terms, or (d) your violation of any third-party rights, including the terms of connected platforms such as LinkedIn, X, Google, or Microsoft.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the service shall be resolved exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of such courts.

13. Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance.
